General and purchasing conditions

The owner of the online shop sunnyday.ee (hereinafter referred to as the Online Shop) is Sunnyday OÜ (registration code 14126779, located at Rähni tee 1 Kloogaranna Harjumaa).

Validity of the sales contract, goods and price information.

Müügitingimused kehtivad Veebipoest kaupade ostmisel.
Veebipoes müüdavate toodete hinnad on märgitud toodete juurde. Hinnale lisandub tasu kauba kättetoimetamise eest.
Kauba kättetoimetamise tasu sõltub ostja asukohast ning kättetoimetamise viisist. Kättetoimetamise tasu kuvatakse ostjale tellimuse vormistamisel. Kõik kuvatavad tooted ei pruugi alati laos olemas olla. Kuvatud tootepildid võivad erineda tegelikust tootest. E-poes olevad tootekirjeldused ei pruugi olla ammendavad ja võivad sisaldada tahtmatuid vigu. Teave kauba kohta on esitatud Veebipoes vahetult kauba juures.

Placing an order

In order to place an order, you must add the products you wish to order to your shopping cart. In order to place an order, you must fill in the required fields and select the appropriate delivery method. The amount of the fee, which can be paid by bank transfer, is then displayed on the screen.

The contract will enter into force as soon as the amount due has been credited to the bank account of the Webshop. In the event that the goods ordered cannot be delivered due to expiry of the goods or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded immediately, but not later than 14 days after the notification.

Coupons – We offer promotional coupons to our customers during various promotions. We share coupons on social media (Facebook), website. The terms and conditions of use of the coupon and the deadlines are indicated separately for each coupon.

Description of payment methods and currency

In the e-shop, you can pay through the secure payment centre with all Estonian internet bank accounts (Swedbank, SEB, Luminor, LHV, Coop and Pocopay). You can also pay by Visa and Master card. Settlement currency is Euro.

Sunnyday OÜ is the controller of personal data, your company will transfer the personal data necessary for the execution of payments to the authorised processor Maksekeskus AS.

Delivery

Goods are shipped in Estonia. All products will be delivered by Itella SmartPost, DPD and Omniva to the parcel terminal of the customer’s choice. The shipping costs are borne by the buyer and the corresponding price information is displayed with the shipping method. Itella SmartPost, DPD and Omniva will generally deliver the goods to the destination specified by the buyer within 3-7 working days from the entry into force of the sales contract.

The maximum delivery time is 7 working days from the entry into force of the sales contract.

The customer has the option to collect the products himself. Once the payment has been successful, the representative of the Online Shop will send an e-mail and the delivery of the product will be agreed.

Right of withdrawal

After receipt of the order, the buyer has the right to withdraw from the contract concluded with the Online Shop within 14 days.

The right of withdrawal does not apply if the buyer is a legal person. In order to exercise the right of withdrawal within 14 days, the goods ordered may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods, in the same way as is allowed for testing the goods in a physical shop. If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods, or if the goods show signs of use or wear, the Online Shop shall be entitled to reduce the refundable amount in accordance with the reduction in the value of the goods.

In order to return the goods, a withdrawal form must be submitted, the form of which can be found here: withdrawal form and sent to the e-mail address info@sunnyday.ee within 14 days of receipt of the goods at the latest.

The cost of returning the goods is to be borne by the purchaser, unless the reason for returning the goods is that the goods to be returned are not as ordered (e.g. wrong or defective goods). The purchaser must return the goods within 14 days of the date of the application or provide proof that he has handed them over to the carrier within the aforementioned period.

Upon receipt of the goods to be returned, the online shop will reimburse to the purchaser immediately, but not later than 14 days after receipt of the request for withdrawal, all the payments received from the purchaser under the contract.

The online shop may refuse to make refunds until it has received the return of the goods that are the subject of the contract or until the buyer has provided proof that it has returned the goods, whichever is the earlier. If the purchaser has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop is not obliged to reimburse the consumer for the cost that exceeds the cost of the usual delivery method. The online shop has the right to withdraw from the sale and to demand the return of the goods from the purchaser if the price of the goods in the online shop is, due to a mistake, marked significantly below the market price of the goods.

Right to lodge a complaint

The online shop is liable for the non-conformity or defect of the goods sold to the buyer, which already existed at the time of delivery and which becomes apparent within a period of up to two years from the delivery of the goods to the buyer. During the first six months after the delivery of the goods to the purchaser, the defect is presumed to have existed at the time of delivery. It is the responsibility of the Online Shop to rebut this presumption. In the event of a defect, the purchaser has the right to contact the online shop within two months at the latest by sending an e-mail to info@sunnyday.ee or by calling 53311165.

The Online Shop is not liable for defects that occur after the delivery of the goods to the buyer. If the goods purchased from the Webshop have defects for which the Webshop is liable, the Webshop will repair or replace the defective goods. In the event that the goods cannot be repaired or replaced, the Online shop will refund the buyer all the fees due under the sales contract. The online shop will respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The online shop will use the personal data provided by the buyer (including name, telephone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer. The online shop transfers personal data to companies providing transport services in order to deliver the goods. The online shop sends newsletters and offers to the buyer’s e-mail address only if the buyer has expressed his/her wish to receive them by entering his/her e-mail address on the website and has indicated his/her wish to receive direct mail notifications. The purchaser may opt out of receiving offers and newsletters by e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

Dispute resolution

If a buyer has a complaint about the Online Store, they should send it by e-mail to info@sunnyday.ee or call 53311165. If the buyer and the Online Shop are unable to settle the dispute by agreement, the buyer can refer the matter to the Consumer Disputes Committee. The terms and conditions of the procedure can be found on the website and the application can be submitted by e-mail. The Consumer Disputes Committee is competent to settle disputes arising from a contract between the buyer and the online shop. The examination of the buyer’s complaint by the Commission is free of charge. The buyer may refer the matter to the European Union’s consumer dispute resolution platform.
